Legislation

The Employees' Compensation Ordinance applies to all full-time or part-time employees who are employed under contracts of service or apprenticeship, including Smart Helpers irrespective of the mode of employment. According to Section 40 of the Employees' Compensation Ordinance, no employer shall employ any employee in any employment unless there is in force a policy of insurance to cover their liabilities both under the Ordinance and at common law for injuries at work in respect of all their employees, irrespective of the length of employment contract or working hours, full-time or part-time, permanent job or temporary employment. Should there be any enquiries on legal liability, employers should seek professional legal advice.

An employer who fails to comply with the Ordinance to secure an insurance cover commits an offence and is liable on conviction to a maximum fine of $100,000 and imprisonment for two years.


Coverage

Employees' compensation insurance policies available in the market mostly cover employers' liabilities under the Employees' Compensation Ordinance and the common law. Employers should thoroughly understand the terms of an insurance policy before taking out the cover. For enquiries, please contact your insurer.


Taking out Employees' Compensation Insurance

Employers should decide on the type of employees' compensation insurance policy for their Smart Helpers according to the length of employment period. Employers have the sole discretion to choose any insurer regardless of the kind of insurance policy to be taken out.

Short-Term Insurance Policy

To provide convenience for employers, the Employees Retraining Board has made arrangements with designated insurers to enable employers to take out, at their own discretion, short-term (one-off or two-week) insurance policy for their Smart Helpers conveniently through the Smart Living - Regional Service Centres.

Long-term Insurance Policy

There are various long-term insurance policies available in the market. The following information is only for employers' reference and consideration.

Remarks: The ERB and the Regional Service Centres are not involved in the transactions between the employers and insurance companies in respect of taking out the employees' compensation insurance. Therefore, the ERB, the RSCs and their staff shall refute any liability to the insurance matter made between the employers and insurance companies.
